3. Licensing terms and conditions
3.1 Available licence periods
Our user licences offer flexible access adapted to different training needs:

3.2 Activation and use
Licence security :
- Once a licence has been activated, it is linked in the following way exclusive to a specific device
- This link guarantees data security and prevents unauthorised reinstallation.
- Any attempt to circumvent these restrictions is strictly prohibited
- Violations may result in immediate suspension of the licence
3.3 Responsibility of the user
- The user is responsible for installing the licence correctly.
- Activation must be carried out on a compatible device (see list of recommended equipment).
- Immergence Studio cannot be held responsible in the event of incompatibility resulting from equipment that is not recommended.
- The minimum system requirements must be met to ensure correct operation
3.4 FAST XR subscription - Go Edition - VSE/Freelance offer
3.4.1 Presentation of the offer
FAST XR - Go Edition is a monthly subscription specially designed for very small businesses, the self-employed and self-entrepreneurs. This preferential price offer gives access to a lighter version of FAST XR, exclusively in augmented reality (AR).

- Augmented reality modules only: Access to fire training scenarios in AR
- Augmented fire extinguisher with 3D tracking
- Realistic, customisable scenarios in AR
- Unlimited training sessions
- Priority premium technical support
- Full documentation and Press Kit
- One hour of personalised support to help you get started
Exclusions - Not included in FAST XR - Go Edition :
- đ« Virtual reality (VR) modules
- đ« Immersive VR scenarios
- đ« Advanced multi-user modules in VR
- đ« Premium features reserved for full licences
3.4.2 Strict eligibility conditions
The FAST XR - Go Edition subscription at 159 incl. VAT/month is reserved exclusively for organisations meeting all of the following criteria:

â ïž Mandatory check : The subscriber must go through the qualification questionnaire before subscribing. Any subscription without prior validation of the eligibility criteria will be considered non-compliant.
3.4.3 Verification and cancellation rights
Immergence Studio reserves the right to:
- Check at any time the subscriber's company status
- Request supporting documents (KBIS extract, VAT return, balance sheet, VAT exemption certificate)
- Suspend the subscription immediately if supporting documents are not provided within 15 days
- Cancel subscription automatically if the eligibility criteria are not met
3.4.4 Consequences of non-compliance with eligibility criteria
In the event of proven non-compliance with eligibility criteria :
Cancellation procedure :
- Email notification: The subscriber will receive an email informing them that the criteria have not been met.
- 7-day period : The subscriber has 7 days to provide proof of eligibility.
- Automatic cancellation : Once this period has elapsed without proof, the subscription will be automatically cancelled.
- Access revoked : Access to FAST XR - Go Edition is immediately deactivated

- Commitment: No commitment - Can be cancelled at any time
- Payment : Automatic monthly via Stripe
- Billing : The same day every month
- Cancellation : From the customer area, effective at the end of the current period
- Renewal : Automatic unless cancelled
3.4.6 Transition to a professional offering
If your organisation no longer meets the eligibility criteria (growth in turnover, VAT liability, increase in workforce), you must :

- Migrate to a Full FAST XR licence with VR and AR modules
- Subscribe to'FAST XR Pro subscription to âŹ289 excl. tax/month
- Opt for a Customised annual licence
- Get a Customised corporate offer
Transition support : Immergence Studio is committed to supporting FAST XR - Go Edition subscribers in their transition to a suitable professional offering, with a 30-day transition period and transfer of training data.
3.4.7 Specific legal information
The subscriber acknowledges and accepts that :
- The FAST XR - Go Edition offer is a preferential rates reserved for VSEs/independent businesses
- Any false declaration constitutes a breach of these GCS
- Immergence Studio can check at any time compliance with eligibility criteria
- Cancellation for non-compliance with criteria does not give entitlement to any compensation
- Months already billed are not refundable in the event of cancellation for non-eligibility

- Login : Stable Wi-Fi (minimum 25 Mbps for streaming)

6. Return and refund policy
6.1 Return of equipment
Returns of equipment are accepted under the following conditions:
Accepted return conditions:
- Product returned in its original packaging and in perfect condition
- All accessories and documentation must be included
- No withdrawal period: sales are exclusively reserved for professionals and are therefore not subject to the right of withdrawal provided for in the Consumer Code (article L221-18 et seq.).
- Product free from all traces of intensive use or deterioration
Return postage :
- At the customer's expense, except in the event of a proven product defect attributable to Immergence Studio
- Secure, insured packaging required for return transport
- Restocking fee: 15% of the amount invoiced in the event of a faultless return
6.2 Licence refunds
Because of their digital nature, activated licences follow specific rules:

Immergence Studio cannot be held responsible for damage resulting from :
- Improper use : Misuse of training applications
- Equipment not recommended: Uncertified or obsolete equipment
- Unsuitable environment : Insufficient space, inadequate lighting
- User negligence : Lack of maintenance, incorrect handling
- Force majeure : Events beyond our control
7.2 Guarantee of conformity

7.3 Technical support

Immergence Studio's liability is limited to the amount actually paid by the customer. We cannot be held responsible for indirect damages, operating losses or immaterial damages.
8. Intellectual property rights
8.1 Protection of our creations
All solutions offered by Immergence Studio are protected by intellectual property rights:

- FAST XR, HELP XR, Risk Hunter XR, Fault Line XR : Software and content
- Algorithms and simulation engines : Proprietary technologies
- Teaching content : Scenarios, exercises, assessments
- Design and interfaces : Visual and ergonomic elements
- Brands and logos : PRO-XR and communication elements
8.2 Formal prohibitions
Actions strictly prohibited:
- đ« Unauthorised reproduction: Copying and duplicating software
- đ« Reverse engineering : Decompilation, source code analysis
- đ« Modification : Alteration of applications or content
- đ« Redistribution : Resale and subletting of licences
- đ« Unauthorised commercial use : Operating without an appropriate licence
8.3 Rights of use granted
The acquisition of a PRO-XR licence only grants :
- Right of use : Use in accordance with the licence
- Training your staff : Internal educational use
- Integration into your programmes : Under the terms of the licence
- Support and updates : During the period of validity
8.4 Penalties for breaches
Any infringement of our intellectual property rights may result in :
- Immediate suspension of licence
- Civil and criminal proceedings
- Damages and interest
- Ban on access to our future products
8.5 Protection of material products
In addition to protecting its software, Immergence Studio also holds exclusive rights to the hardware products associated with its immersive solutions:

- âïž Parts and fastening systems designed and printed in 3D

8.6 Specific prohibitions
Actions strictly forbidden without written authorisation from Immergence Studio:
- đ« Reproduction, copying or 3D printing of our parts, prototypes or attachment systems.
- đ« Manufacture or distribution of replicas, even partial, of educational fire extinguishers or of the AR lance.
- đ« Marketing of any derivative product using our designs, concepts or proprietary technologies.
- đ« Use of our hardware products for reverse engineering or competitive development purposes.
8.7 Reinforced penalties
Any reproduction or misappropriation of our material products constitutes an act of fraud. counterfeiting and commercial parasitism. These violations expose the perpetrator to :
- Civil and criminal proceedings (Intellectual Property Code - articles L335-2 et seq.)
- Claim for damages covering the entire loss suffered
- Immediate ban on use and recall of counterfeit products
9. Protection of personal data
The use of our solutions involves the processing of personal data for training purposes. This processing is governed by our Privacy Policy available on pro-xr.com.

11. Jurisdiction and applicable law

These General Terms and Conditions of Sale are subject to the French law.
11.2 Dispute resolution

12.1 Entire agreement
These GTC constitute the entire agreement between PRO-XR and the Client, unless special conditions are expressly agreed in writing.
12.2 Partial nullity
If any provision is found to be invalid or unenforceable, the other provisions shall remain in full force and effect.
12.3 Storage and archiving
Immergence Studio keeps the General Terms and Conditions applicable to each order for the legal retention period (10 years for invoices, 3 years for commercial data).
12.4 Force majeure
Immergence Studio shall not be held liable for failure to perform its obligations in the event of force majeure or exceptional circumstances beyond its control.
