2. Presentation of the offer

PRO-XR offers a complete range of immersive solutions dedicated to safety and prevention training through innovative virtual reality (VR) and augmented reality (AR) technologies.

3. Licensing terms and conditions

3.1 Available license periods

Our user licenses offer flexible access to suit different training needs:

3.2 Activation and use

License security :

  • Once activated, a license is linked to a specific exclusive to a specific device
  • This link guarantees data security and prevents unauthorized reinstallation.
  • Any attempt to circumvent these restrictions is strictly prohibited
  • Violations may result in immediate suspension of the license.

3.3 User responsibility

  • The user is responsible for the correct installation of the license.
  • Activation must be performed on a compatible device (see list of recommended equipment).
  • Immergence Studio cannot be held responsible for any incompatibility resulting from equipment not recommended by Immergence Studio.
  • To ensure proper operation, the following minimum system requirements must be met

3.4 FAST XR subscription - Go Edition - VSE/Freelance offer

3.4.1 Presentation of the offer

FAST XR - Go Edition is a monthly subscription specially designed for small businesses, freelancers and self-employed entrepreneurs. This preferential price offer gives access to a lighter version of FAST XR, exclusively in augmented reality (AR).

Contents of the FAST XR - Go Edition subscription :

  • Augmented reality modules only: Access to fire training scenarios in AR
  • Augmented fire extinguisher with 3D tracking
  • Realistic, customizable AR scenarios
  • Unlimited training sessions
  • Priority premium technical support
  • Full documentation and Press Kit
  • One-hour personalized start-up coaching

Exclusions - Not included in FAST XR - Go Edition :

  • 🚫 Virtual reality (VR) modules
  • 🚫 Immersive VR scenarios
  • 🚫 Advanced multi-user modules in VR
  • 🚫 Premium features reserved for full licenses

3.4.2 Strict eligibility conditions

FAST XR - Go Edition subscription at 159/month incl. VAT is reserved exclusively for structures meeting all of the following criteria:

Professional status VSE, self-employed, auto-entrepreneur (fewer than 10 employees)
Annual sales Less than €100,000 excl.
VAT liability NOT subject to VAT (basic VAT exemption)

3.4.3 Verification and cancellation rights

Immergence Studio reserves the right to :

  • Check at any time the subscriber's corporate status
  • Request supporting documents (KBIS extract, VAT declaration, balance sheet, VAT exemption certificate)
  • Suspend subscription immediately in the event of failure to provide supporting documents within 15 days
  • Cancel subscription automatically if eligibility criteria are not met

3.4.4 Consequences of non-compliance with eligibility criteria

In the event of proven non-compliance with eligibility criteria :

Cancellation procedure :

  1. Email notification : The subscriber receives an email informing him or her that the criteria have not been met.
  2. 7-day period : The subscriber has 7 days to provide proof of eligibility.
  3. Automatic cancellation : After this period without proof, the subscription is automatically cancelled.
  4. Access revoked : Access to FAST XR - Go Edition is immediately deactivated

3.4.5 Subscription terms and conditions

Subscription features :

  • Price : 159 € incl. VAT / month
  • Commitment: No commitment - Can be cancelled at any time
  • Payment : Automatic monthly via Stripe
  • Billing : The same day every month
  • Cancellation : From the customer area, effective at the end of the current period
  • Renewal : Automatic unless terminated

3.4.6 Transition to a professional offer

If your organization no longer meets the eligibility criteria (sales growth, VAT liability, increase in workforce), you must :

Migration options :

  • Notify us of your change of status: contact@pro-xr.com
  • Migrate to a Full FAST XR license with VR and AR modules
  • Subscribe to'FAST XR Pro subscription to €289 excl. tax/month
  • Opt for a Customized annual license
  • Get a Customized corporate offer

3.4.7 Specific legal information

The subscriber acknowledges and accepts that :

  • The FAST XR - Go Edition offer is a reserved preferential pricing very small businesses/independents
  • Any false declaration constitutes a breach of these GTC
  • Immergence Studio can check at any time compliance with eligibility criteria
  • Cancellation for non-compliance with criteria does not entitle you to any compensation
  • Months already billed are non-refundable in the event of cancellation for non-eligibility

4.2 Configuration and compatibility

Minimum recommended specifications :

  • VR headsets : Meta Quest 3 (recommended), HTC Vive Pro, Pico 4 Enterprise
  • Play area : 2m x 2m minimum for virtual reality
  • Login : Stable Wi-Fi (minimum 25 Mbps for streaming)
  • Lighting : Optimal ambient lighting for AR tracking

4.3 Warranty and maintenance

Warranty exclusions : The warranty does not apply in the event of misuse, unauthorized modification of the equipment, dropping or liquid damage.

5.1 Terms of payment

  • Individuals and small businesses : Full payment on order
  • SME/ETI : Deposit 50% - Balance on delivery
  • Key accounts : Negotiated conditions as per framework agreement

6. Return and refund policy

6.1 Returning equipment

Material returns are accepted under the following conditions:

Accepted return conditions :

  • Product returned in its original packaging and in perfect condition
  • All accessories and documentation must be included
  • No right of withdrawal: sales are exclusively reserved for professionals and are therefore not subject to the right of withdrawal provided for in the French Consumer Code (article L221-18 et seq.).
  • Product free from all traces of intensive use or deterioration

Return shipping :

  • At the customer's expense, except in the case of a proven product defect attributable to Immergence Studio.
  • Secure, insured packaging mandatory for return shipment
  • Restocking fee: 15% of the invoiced amount in the event of a defect-free return

6.2 Licence refunds

Because of their digital nature, activated licenses follow specific rules:

6.3 Return procedure

  4. Ship with visible RMA number
  5. Refund within 14 days of receipt

7. Limitation of liability and warranties

7.1 Use and maintenance

Immergence Studio cannot be held responsible for damages resulting from :

  • Improper use : Misuse of training applications
  • Equipment not recommended: Uncertified or obsolete equipment
  • Unsuitable environment : Insufficient space, inadequate lighting
  • User negligence : Lack of maintenance, incorrect handling
  • Force majeure : Events beyond our control

7.2 Warranty of conformity

Our commitments:

  • Products meet advertised specifications
  • Applications tested and validated on recommended equipment
  • Compliance with current safety standards
  • Regular updating of educational content

7.3 Technical support

We offer comprehensive technical support to ensure :

7.4 Limitation of liability

8. Intellectual property rights

8.1 Protection of our creations

All solutions offered by Immergence Studio are protected by intellectual property rights:

  • FAST XR, HELP XR, Risk Hunter XR, Fault Line XR : Software and content
  • Algorithms and simulation engines : Proprietary technologies
  • Teaching content : Scenarios, exercises, assessments
  • Design and interfaces : Visual and ergonomic elements
  • Brands and logos : PRO-XR and communication elements

8.2 Formal prohibitions

Actions strictly prohibited:

  • 🚫 Unauthorized reproduction: Copying and duplicating software
  • 🚫 Reverse engineering : Decompilation, source code analysis
  • 🚫 Modification : Alteration of applications or content
  • 🚫 Redistribution : Resale and sublease of licenses
  • 🚫 Unauthorized commercial use : Operating without an appropriate license

8.3 Rights of use granted

The acquisition of a PRO-XR license grants only :

  • Right of use : Use in accordance with the license
  • Training your staff : Internal educational use
  • Integration into your programs : Under the terms of the license
  • Support and updates : During the validity period

8.4 Penalties for violations

Any infringement of our intellectual property rights may result in :

  • Immediate suspension of license
  • Civil and criminal proceedings
  • Damages and interest
  • No access to our future products

8.5 Protecting material products

In addition to software protection, Immergence Studio also holds exclusive rights to the hardware products associated with its immersive solutions:

Protected products :

  • 🧯 Educational fire extinguishers (VR/AR and hybrid physical/virtual models)
  • 🚒 Augmented fire hose (3-in-1 system)
  • ⚙️ 3D-printed parts and fastening systems
  • 📦 Complete teaching kits and customized accessories

8.6 Specific prohibitions

Actions strictly forbidden without written authorization from Immergence Studio:

  • 🚫 Reproduction, copying or 3D printing of our parts, prototypes or fastening systems
  • 🚫 Manufacture or distribution of replicas, even partial, of educational fire extinguishers or the AR lance.
  • 🚫 Marketing of any derivative product using our proprietary designs, concepts or technologies
  • 🚫 Use of our hardware products for reverse engineering or competitive development purposes

8.7 Reinforced penalties

9. Personal data protection

The use of our solutions involves the processing of personal data for training purposes. This processing is governed by our Privacy Policy available on pro-xr.com.

  • Minimal and transparent data collection
  • Advanced information security
  • Respect for all your rights (access, rectification, deletion)
  • Secure hosting in Europe
  • No resale of data to third parties

10. Modification of general terms and conditions

10.1 Possible developments

Immergence Studio reserves the right to modify its terms and conditions of sale in order to adapt :

  • Technical upgrades to our solutions
  • Regulatory changes
  • Improving our services
  • Developments in the VR/AR training market

10.2 Customer information

Notification procedure :

10.3 Acceptance of modifications

The new conditions apply:

  • Automatically on new orders
  • Licenses renewed after the effective date
  • Possibility of refusing major modifications (termination of contract)

11. Jurisdiction and applicable law

11.1 Applicable law

The present General Terms and Conditions of Sale are subject to the French law.

11.2 Dispute resolution

Amicable resolution procedure :

  1. Direct contact: contact@pro-xr.com - Claims department
  2. Internal mediation : Attempt to resolve within 30 days
  3. External mediation : Use of a professional mediator
  4. Legal action : Only as a last resort

11.3 Jurisdiction

  • Consumers : Courts of the customer's domicile or registered office
  • Professionals : Competent courts in Nantes
  • International disputes : In accordance with applicable international conventions

11.4 Consumer mediation

12. General provisions

12.1 Entire agreement

These General Terms and Conditions constitute the entire agreement between PRO-XR and the Customer, unless otherwise expressly agreed in writing.

12.2 Partial nullity

If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.3 Storage and archiving

Immergence Studio keeps the General Terms and Conditions applicable to each order for the legal retention period (10 years for invoices, 3 years for commercial data).

12.4 Force majeure

Immergence Studio shall not be held liable for non-performance of its obligations in the event of force majeure or exceptional circumstances beyond its control.
